1. Acceptance of Terms

By accessing or purchasing from the G-code & Engineering Mart website (“GEM”), you agree to be bound by these Terms of Service. If you do not agree, do not use the store.

2. Digital Products

All products sold by GEM are digital and include, but are not limited to:

G‑code libraries and postprocessors for CNC machines
Project templates for PLC and SCADA systems
Digital Twin packages for virtual commissioning

No physical goods are sold. Product descriptions, compatibility notes, and file formats are stated on each product page.

3. License and Use Rights

When you purchase a digital product from GEM, you receive a non-exclusive, non-transferable, perpetual license to use the files for your own internal business or personal projects, unless otherwise specified.

You may:

Use the files on any number of machines owned or operated by your company
Modify the files to fit your specific application
Integrate the files into your own automated equipment or production lines

You may NOT:

Sell, redistribute, or share the original (or substantially similar) files to third parties
Upload the files to public repositories, file‑sharing sites, or resell them as your own product
Use the files for illegal purposes or in violation of export control laws

4. Account and Order Accuracy

You are responsible for providing accurate billing and contact information. GEM reserves the right to refuse or cancel any order if fraud or unauthorized activity is suspected.

After purchase, you will receive a download link valid for 7 days (up to 3 download attempts). It is your responsibility to save the files locally.

5. Intellectual Property

All product files, descriptions, logos, and website content are the property of Dakota Automation, Inc. / G-code & Engineering Mart. Unauthorized copying or distribution may result in legal action.

6. Disclaimer of Warranties

Digital products are provided “as is” and “as available” without any express or implied warranties, including but not limited to compatibility with your specific machinery, controller, software version, or operating system.

While we strive for accuracy, we do not warrant that the files are error‑free or that they will meet your exact requirements. You assume full responsibility for verifying file compatibility before use in production environments.

7. Limitation of Liability

To the maximum extent permitted by law, G-code & Engineering Mart and its parent company (Dakota Automation, Inc.) shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our digital products, including but not limited to machine downtime, lost production, or damage to equipment.

Our total liability for any claim related to a purchase shall not exceed the amount you paid for that product.

8. Indemnification

You agree to indemnify and hold harmless GEM, Dakota Automation, Inc., and their employees, officers, and agents from any claims, losses, or damages (including legal fees) arising from your use of our products or violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict of law principles. Any legal action must be brought in Codington County, South Dakota.

10. Changes to Terms

We may update these Terms from time to time. Changes are effective immediately upon posting on this page. Your continued use of the store after changes constitutes acceptance.
